Driver who fatally struck baby in Va. crosswalk indicted on manslaughter charges

WASHINGTON 鈥 The driver who struck and killed an infant being pushed by his mother in a stroller in a Lansdowne, Virginia, crosswalk in August has been indicted on involuntary manslaughter charges, the Loudoun County Office of the Commonwealth’s Attorney said in a statement Monday.

John Miller, 45, of Leesburg also is being charged with failing to yield to a pedestrian in a crosswalk and reckless driving charges in the death of 5-month-old Tristan Schultz.

The baby’s mother was seriously injured in the Aug. 31 crash.

Eyewitnesses said Miller was before his Jeep plowed into the crosswalk at Riverside Parkway and Kipheart Drive, according to a law enforcement affidavit.

Another driver, who was following behind Miller, said he saw the man 鈥渉olding a phone in his left hand as if he was watching or reading something鈥 before the crash, the affidavit stated.
